Terms of Service

Important — Please Read Carefully These Terms constitute a legally binding agreement. By connecting your Spotify account or using any part of the Service, you agree to be bound by these Terms in full.

BY CLICKING "I UNDERSTAND — CONNECT SPOTIFY," YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS, INCLUDING THE DISCLAIMERS, LIMITATIONS OF LIABILITY, AND INDEMNIFICATION PROVISIONS BELOW.

1. Description of Service

RealSongCheck is a user-directed music library management tool. The Service analyses the contents of your personal Spotify library using algorithmic scoring methods and presents results to you. You then choose what actions, if any, to take. RealSongCheck does not make decisions on your behalf without your explicit authorisation.

The Service provides:

Probabilistic algorithmic analysis of tracks in your Spotify library
A risk score and supporting signals for each track, presented as informational output
Tools enabling you to remove, flag, trust, or block tracks and artists within your own Spotify account
Optional automated actions that you explicitly enable, including automatic removal of high-risk tracks

All actions taken within your Spotify account are taken at your direction and on your behalf. RealSongCheck acts as your agent in executing actions you have authorised.

2. Probabilistic Nature of Results — No Guarantee of Accuracy

THE SERVICE DOES NOT AND CANNOT GUARANTEE THAT ANY TRACK OR ARTIST FLAGGED BY THE SERVICE IS AI-GENERATED, OR THAT ANY TRACK OR ARTIST CLEARED BY THE SERVICE IS HUMAN-MADE.

All scores, flags, risk ratings, and classifications produced by RealSongCheck are:

Probabilistic algorithmic opinions, not verified facts
Based on indirect signals including but not limited to: distributor information, release patterns, artist metadata, track naming conventions, and other observable data
Subject to error, including both false positives (human-made content incorrectly flagged) and false negatives (AI-generated content not detected)
Not representations of fact about any artist, label, distributor, or rights holder

You acknowledge and accept that the Service may flag music created by human artists. You understand that acting on these results — including removing tracks from your library — is your own decision and carries the risk of affecting music you may wish to keep.

3. User-Directed Actions and Your Responsibility

3.1 You Are the Decision-Maker

Every action taken within your Spotify account through RealSongCheck is a user-directed action. You retain full control and responsibility for:

Which tracks and artists are removed from your library
Which distributors, labels, and artists are added to your personal or global block lists
Enabling or disabling automated features such as auto-removal or auto-skip
Any and all consequences of actions taken through the Service

3.2 Authorisation of Automated Features

If you enable automated features (such as automatic removal of high-risk tracks), you are explicitly authorising RealSongCheck to perform those actions on your behalf within your Spotify account, subject to the risk thresholds you have set or accepted. You understand that automated actions may affect tracks before you have individually reviewed them.

3.3 Your Acceptance of RealSongCheck's Scoring Methodology

By using the Service, you acknowledge and agree that:

RealSongCheck applies its own proprietary scoring methodology to evaluate tracks in your library
You authorise RealSongCheck to apply this methodology on your behalf when performing actions in your Spotify account
The categories, thresholds, and definitions used by the Service — including the definition of what constitutes "AI-generated music" for the purposes of the Service — are determined by RealSongCheck at its sole discretion
You accept these definitions and methodologies as the basis on which the Service operates, while retaining the right to review, override, or ignore any individual result

4. No Liability for Third-Party Content or Accounts

4.1 Artist and Rights Holder Claims

RealSongCheck does not publish, distribute, or make available any artist's music. The Service only helps you manage your own personal Spotify library — content you have already saved or liked. The Service does not:

Remove music from Spotify or any streaming platform
Make any public statement about any artist, label, or distributor
Publish or share any classification or flag beyond your personal account
Interfere with any artist's ability to distribute, monetise, or make available their music

Any action taken through the Service affects only your personal library. An artist, label, or distributor cannot bring a claim against RealSongCheck arising from a user's personal decision to remove a track from their own saved library, as such actions fall entirely within the user's own rights as a Spotify subscriber.

4.2 Spotify Account

RealSongCheck is not affiliated with, endorsed by, or in any way officially connected with Spotify AB. Your use of RealSongCheck is subject to Spotify's own Terms of Service. We are not responsible for:

Changes to Spotify's API, terms, or service that affect the functionality of RealSongCheck
Any suspension, restriction, or termination of your Spotify account, regardless of cause
Any data loss, playback issues, playlist changes, or other effects within your Spotify account
Any failure of Spotify's systems or our integration with them

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, REALSONGCHECK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
Any warranty that the Service will be uninterrupted, timely, secure, or error-free
Any warranty regarding the accuracy, completeness, or reliability of any results, scores, flags, or classifications produced by the Service
Any warranty that the Service will detect all AI-generated music, or that it will not flag human-made music

YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SERVICE AND ANY ACTIONS YOU TAKE BASED ON ITS OUTPUT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REALSONGCHECK AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

Loss of data, including tracks, playlists, or library content removed through the Service
Loss of access to, or changes in, your Spotify account
Emotional distress arising from the removal of content from your library
Any claim by a third party including artists, labels, or distributors arising from your use of the Service
Any business losses, loss of revenue, or loss of goodwill

IN NO EVENT SHALL REALSONGCHECK'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO REALSONGCHECK IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED POUNDS STERLING (£100).

7. Indemnification

You agree to indemnify, defend, and hold harmless RealSongCheck and its owners, operators, employees, affiliates, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use of the Service
Any actions taken within your Spotify account through or as a result of the Service
Your violation of these Terms
Any claim by a third party arising from actions you have taken using the Service, including any claim by an artist, label, or distributor whose music was removed from your library
Your violation of any third-party rights, including Spotify's Terms of Service

8. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation
Circumvent, disable, or interfere with any security feature of the Service
Use the Service in any way that could damage, disable, overburden, or impair it
Attempt to gain unauthorised access to any part of the Service or its systems
Use the Service for any commercial purpose without our written consent

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause and with or without notice.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your data as described there.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the effective date at the top of this document. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

You agree that any claim arising from your use of the Service must be brought within one (1) year of the event giving rise to the claim, or be permanently barred.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RealSongCheck with respect to the Service and supersede all prior agreements and understandings.
